This Privacy Policy explains how Scuber Technologies, LLC, a Missouri limited liability company (“Scuber,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you use our websites, mobile applications, and related services (collectively, the “Platform”).
This Privacy Policy applies to Customers, Divers, prospective users, website visitors, and other individuals interacting with Scuber.
1. Information We Collect#
A. Account and Contact Information#
We may collect information you provide when creating or maintaining an account, including:
- name;
- email address;
- telephone number;
- mailing or contact address;
- username;
- account preferences;
- profile photograph; and
- authentication information.
B. Diver Certification Information#
We may collect certification information supplied by Divers, including:
- certification agency;
- certification number;
- certification level;
- name associated with the credential;
- certification cards or electronic credentials; and
- information received from certification agencies or verification providers when confirming a credential.
C. Diver Insurance Information#
If a Diver uploads insurance documentation, we may collect the information contained in that documentation, including:
- insured name;
- insurance provider;
- policy or certificate number;
- coverage information;
- policy dates; and
- uploaded insurance certificates or other supporting documents.
D. Job Information#
We may collect information Customers and Divers provide in connection with a Job, including:
- descriptions of lost property;
- photographs;
- date and circumstances of the loss;
- Job location;
- approximate depth and known water conditions;
- known hazards;
- access instructions and restrictions;
- Diver default Minimum Service Fee settings;
- offers, accepted Minimum Service Fees, Recovery Prices, and other accepted Job terms;
- Customer approvals of service-price changes;
- scheduling information;
- arrival confirmations and on-site assessment information;
- cancellation, rescheduling, and minimum-fee waiver records; and
- Job status and outcome, including whether a dive occurred or an item was recovered.
E. Precise Location Information#
We may collect precise location information you provide through maps, location pins, coordinates, or other Job details.
With your device permission, where applicable, we may also receive location information from your device to support mapping and location functions.
You may disable device-location permission through your device settings. Doing so does not remove location information you have separately provided in a Job or message.
F. Recovery Evidence#
We may collect evidence submitted to document a search, recovery, completion, or dispute, including:
- photographs;
- videos;
- recovery and on-site assessment descriptions;
- arrival confirmations;
- timestamps;
- location information; and
- other supporting information supplied by Customers or Divers.
G. Payment Information#
Our third-party payment providers may collect payment and payout information directly from you, including:
- payment-card numbers;
- expiration dates;
- card security codes;
- billing information;
- bank-account information; and
- identity or other information required to process payments, payouts, or related verification.
Scuber may receive information needed to administer transactions, such as payment status, transaction identifiers, payment-method summaries, authorization and temporary-hold amounts, capture amounts, accepted Minimum Service Fees, Recovery Prices, final Billable Diver Amounts, Customer Service Fees, Diver Marketplace Fees, optional tip amounts, payout status, refund or reversal information, authorization-release status, and dispute information.
Scuber does not offer a separate expense-reimbursement payment option. Job-related costs included in an agreed service price are recorded as part of that service price. Records from transactions under an earlier pricing model may be retained under Section 8.
Scuber does not intend to store complete payment-card security codes.
Your payment provider processes payment information under its own terms and privacy policy.
H. Communications#
We may collect communications you send through the Platform or to Scuber, including:
- Customer-Diver messages;
- customer-support requests;
- dispute communications;
- emails;
- SMS messages; and
- communications with Scuber personnel.
I. Ratings and Reviews#
We may collect:
- star ratings;
- written reviews;
- reports;
- complaints; and
- responses to reviews.
J. Device and Usage Information#
When you access the Platform, we may automatically receive information such as:
- IP address;
- browser type;
- device type;
- operating system;
- device identifiers;
- referring pages;
- pages or screens viewed;
- timestamps;
- application version;
- crash information;
- authentication events; and
- Platform activity.
K. Cookies and Similar Technologies#
Our websites and applications may use cookies, software development kits, local storage, pixels, and similar technologies for:
- authentication;
- security;
- preferences;
- functionality;
- analytics; and
- performance.
Where required by applicable law, we will obtain consent for optional technologies.
2. How We Use Personal Information#
We may use personal information to:
Provide the Platform#
- create and maintain accounts;
- create Jobs;
- connect Customers with Divers;
- enable offers and Diver default Minimum Service Fee settings;
- record accepted pricing and Customer approvals of changes;
- communicate Job information;
- provide mapping and location functions;
- record arrival, assessments, cancellations, and completion; and
- provide customer support.
Verify Diver Credentials#
- review certification information;
- confirm certification credentials where possible;
- detect falsified credentials; and
- enforce Diver eligibility requirements.
Process Payments#
- process Customer payments;
- place and administer payment authorizations and temporary holds;
- capture final transaction amounts;
- process optional tips;
- release or allow unused authorizations to expire;
- administer conditional payouts;
- send Diver payouts;
- issue refunds and reversals;
- determine whether an accepted Minimum Service Fee was earned;
- calculate final Billable Diver Amounts and both Scuber fees;
- collect Scuber fees;
- manage chargebacks; and
- reconcile transactions.
Protect Users and the Platform#
- investigate suspected fraud;
- investigate unsafe or prohibited conduct;
- authenticate accounts;
- prevent unauthorized access;
- enforce our Terms;
- investigate complaints; and
- resolve payment or Job disputes.
Communicate With You#
We may send:
- account messages;
- Job notifications;
- offer notifications;
- payment notifications;
- recovery notifications;
- dispute communications;
- security alerts;
- customer-service communications; and
- legally required notices.
With appropriate consent where required, we may also send promotional communications.
You may unsubscribe from promotional email, but you cannot opt out of transactional communications necessary to operate your account or active Jobs.
Improve Scuber#
We may analyze Platform use to:
- troubleshoot;
- improve usability;
- develop features;
- measure performance;
- understand marketplace activity; and
- improve fraud and security controls.
Where appropriate, we may aggregate or de-identify information.
3. How We Disclose Information#
We may disclose personal information as follows.
A. Between Customers and Divers#
To facilitate a Job, we may provide Customers and Divers with information about one another.
For example, a Diver may receive:
- Customer name or profile information;
- item description;
- photographs;
- Job location;
- access instructions; and
- relevant messages.
Customers may receive:
- Diver name and profile information;
- certification information;
- ratings;
- offer information, including the Diver's applicable Minimum Service Fee and Recovery Price;
- relevant arrival, assessment, and Job-outcome information; and
- an indication that insurance documentation has been uploaded, where applicable.
We seek to limit disclosure to information reasonably necessary for the transaction.
B. Service Providers#
We may provide information to companies that help us operate the Platform, including providers of:
- cloud hosting;
- databases;
- cybersecurity;
- payment processing;
- mapping and geolocation;
- email and SMS;
- identity or certification verification;
- analytics;
- customer support;
- fraud detection; and
- professional services.
Service providers are authorized to process information on our behalf for the purposes for which it was disclosed, subject to applicable contractual and legal requirements.
C. Payment Providers#
We disclose information required to process:
- payment authorizations and temporary holds;
- captures and final charges;
- optional tips;
- service amounts and Scuber fees, including charges based on an earned Minimum Service Fee;
- payments;
- payouts;
- refunds;
- authorization releases;
- reversals;
- fraud screening;
- tax reporting; and
- disputes.
Payment companies may separately collect information directly from you.
D. Certification Providers#
Where Scuber uses certification-verification functionality, we may disclose identifying and credential information to certification agencies or verification providers for the limited purpose of confirming a Diver's credential.
E. Legal and Safety Disclosures#
We may disclose information when we reasonably believe disclosure is necessary to:
- comply with law;
- respond to legal process;
- respond to law enforcement;
- protect the rights or safety of a person;
- investigate fraud;
- respond to emergencies;
- enforce our Terms; or
- protect Scuber's legal rights.
F. Business Transactions#
If Scuber is involved in a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar transaction, personal information may be disclosed to parties involved in that transaction subject to appropriate protections.
G. With Your Direction or Consent#
We may disclose information when you direct us to do so or otherwise consent.
4. Selling Personal Information#
Scuber does not sell personal information for monetary compensation.
Scuber does not intend to use personal information for cross-context behavioral advertising or otherwise “sell” or “share” personal information as those terms are defined by certain state privacy laws without implementing any notices and choices required by applicable law.
5. Public Information#
Some information you choose to include in a Scuber profile may be visible to other Users.
Do not include information in a profile, Job photograph, review, or description that you do not want disclosed to Users who may legitimately view that information.
6. Location Privacy#
Because Scuber facilitates physical recovery services, location information is fundamental to many Jobs.
We may reduce the precision of a location before a Job is accepted and provide the more precise location only when appropriate.
However, Scuber cannot guarantee that a User will be unable to infer a location from photographs, descriptions, maps, messages, or other Job information.
Do not create a Job at a location you do not have authority to access.
7. Certification and Insurance Documents#
Certification and insurance documents may contain more information than Scuber requires.
Users should avoid uploading unnecessary sensitive information.
Scuber may restrict access to full certification and insurance documents while displaying only selected information to Customers or other Users.
Scuber's display of certification or insurance information should not be understood as a guarantee of:
- competence;
- identity beyond the verification performed;
- insurance coverage;
- medical fitness;
- experience; or
- suitability for a particular dive.
8. Data Retention#
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to:
- maintain accounts;
- administer Jobs;
- maintain transaction records;
- resolve disputes;
- prevent fraud;
- meet tax and accounting obligations;
- establish or defend legal claims; and
- comply with law.
Retention periods may vary depending on the category of information.
For example, information concerning a completed Job or payment may be retained longer than temporary application logs because it may be needed for accounting, fraud, dispute, or legal purposes.
When information is no longer reasonably necessary, we may delete, anonymize, or de-identify it unless continued retention is legally required.
9. Data Security#
Scuber uses reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, destruction, loss, alteration, or disclosure.
These measures may include:
- access controls;
- authentication controls;
- encryption where appropriate;
- logging;
- secure communications;
- vendor controls; and
- restricted access to sensitive records.
No internet service or electronic-storage system can be guaranteed completely secure.
Users are responsible for keeping account credentials confidential and for notifying Scuber of suspected unauthorized account access.
10. Security Incidents#
If Scuber experiences a security incident involving personal information, we will investigate and provide notifications as required by applicable law.
11. Children's Privacy#
The Platform is intended only for people 18 years of age or older.
Scuber does not knowingly permit children under 18 to create Customer or Diver accounts.
If you believe a minor has improperly submitted personal information through the Platform, contact us.
12. Your Privacy Choices#
Depending on your account and applicable law, you may be able to:
- update account information;
- change notification preferences;
- disable device-location permission;
- unsubscribe from promotional emails;
- request access to personal information;
- request correction of inaccurate personal information;
- request deletion of certain personal information; or
- request a copy of certain personal information.
Some information cannot be deleted immediately when retention is reasonably necessary for:
- active Jobs;
- payments;
- fraud prevention;
- disputes;
- tax or accounting requirements;
- legal claims; or
- other legal obligations.
13. U.S. State Privacy Rights#
Residents of certain U.S. states may have additional rights under applicable privacy laws.
Depending on the law and whether it applies to Scuber, these may include rights to:
- know or access personal information;
- obtain a portable copy;
- correct inaccuracies;
- delete certain information;
- opt out of certain sales or sharing;
- opt out of targeted advertising;
- opt out of certain profiling; and
- appeal the denial of a privacy request.
Scuber will honor applicable rights when legally required.
We may need to verify your identity before completing a request.
Authorized agents may submit requests where applicable law permits.
Scuber will not unlawfully discriminate against a User for exercising applicable privacy rights.
14. Missouri Residents#
Scuber is organized in Missouri and maintains information concerning Missouri residents.
Missouri law imposes requirements concerning notification when certain personal information is affected by a qualifying security breach.
Scuber will comply with applicable breach-notification obligations.
15. Do Not Track and Global Privacy Signals#
Browser “Do Not Track” signals are not governed by a uniform industry standard.
Where applicable law requires Scuber to recognize a legally valid browser-based opt-out preference signal, Scuber will process that signal as required.
16. International Users#
Scuber is based in the United States.
If you use the Platform from outside the United States, information may be processed in the United States or another country where Scuber or its service providers operate.
Where required, Scuber will implement mechanisms appropriate for international transfers of personal information.
17. Payment Provider Privacy#
Payment providers operate independently from Scuber for certain payment-processing activities, including authorizations, temporary holds, captures, tips, refunds, reversals, payouts, and payment disputes.
When you provide payment information directly to a payment provider, that provider's privacy notice governs its independent collection and processing.
Scuber encourages Users to review the applicable payment provider's privacy terms.
18. Third-Party Links and Services#
The Platform may contain links to or integrations with third-party services.
Scuber is not responsible for the privacy practices of third parties.
Review their privacy policies before providing information.
19. Changes to This Privacy Policy#
We may modify this Privacy Policy as Scuber or applicable law changes.
If changes materially affect how we handle personal information, we will provide notice as appropriate through:
- the Platform;
- email;
- an updated effective date; or
- another reasonable method.
